These General Terms and Conditions apply to all offers, agreements and deliveries of Roger Wanrooij – Art & Design (Chamber of Commerce No. 89394585), located in Venlo, the Netherlands.
1. Definitions
In these Terms and Conditions, the following definitions apply:
- Client: any natural or legal person who enters into an agreement with Roger Wanrooij – Art & Design.
- Artwork: each individual work created by the artist, including original pieces, limited editions, prints and commissioned works.
- Agreement: any arrangement between the client and Roger Wanrooij – Art & Design concerning the sale, delivery or placement of an artwork.
- Trial Placement: a temporary placement of an artwork at the client’s location, without immediate purchase obligation, as defined in Article 8.
2. Applicability
- These Terms and Conditions apply to all quotations, offers, agreements, deliveries and invoices from Roger Wanrooij – Art & Design, unless otherwise agreed in writing.
- Deviations from these Terms are valid only if agreed in writing.
- The client’s own terms and conditions are expressly rejected.
3. Offers and Agreements
- All offers, prices and images on www.rogerwanrooij.nl are non-binding and may be changed at any time without prior notice.
- An agreement is concluded once Roger Wanrooij – Art & Design has confirmed the order in writing or by email.
- Any errors or mistakes in the offer do not bind Roger Wanrooij – Art & Design.
4. Prices and Payment
- All prices are listed in euros and include VAT, unless otherwise stated.
- Payment must be made within the period stated on the invoice and to the designated bank account.
- Ownership of the artwork remains with Roger Wanrooij – Art & Design until full payment has been received.
5. Delivery and Shipping
- Delivery takes place at the address provided by the client.
- Shipping and transport costs are stated in advance or agreed upon in writing.
- Damage or loss during transport must be reported within 48 hours after receipt, accompanied by photographs.
- Delivery times are indicative and exceeding them does not entitle the client to compensation or termination.
6. Unique Works and Colour Variations
- Each artwork is handmade and unique. Minor variations in colour, texture or finish compared to photographs on the website do not constitute grounds for complaint.
- The client acknowledges that natural materials, pigments and metal leaf inherently display variations as part of the artistic process.
7. Right of Withdrawal (Consumers)
- Private buyers have a right of withdrawal of 14 days after receiving the artwork, provided it is unused, undamaged and returned in its original packaging.
- This right does not apply to:
- Custom-made or personalised works;
- Artworks altered or created on the client’s request;
- Digital files or downloadable content.
- Returns are at the client’s cost and risk; items must be shipped insured and trackable.
8. Trial Placement (30 Days)
- A trial placement is only possible after written agreement.
- During the trial period, the artwork remains the property of Roger Wanrooij – Art & Design.
- The client is responsible for insurance and careful handling of the artwork.
- Any damage, loss or theft is fully at the client’s expense.
- If the artwork is not purchased, it must be returned in its original condition and packaging within 5 days after the end of the trial period.
- If the artwork is returned late or damaged, Roger Wanrooij – Art & Design may charge the full sale price or appropriate compensation.
9. Liability
- Roger Wanrooij – Art & Design is not liable for:
- Incorrect installation or handling by third parties;
- Normal wear or ageing of materials;
- Indirect, incidental or consequential damages of any kind.
- Liability is limited to the amount invoiced for the delivered performance, or to the amount paid by the liability insurer.
10. Force Majeure
- In case of force majeure (such as illness, fire, natural disasters, transportation issues or shortage of materials), Roger Wanrooij – Art & Design is entitled to postpone delivery or terminate the agreement in whole or in part, without any obligation to pay compensation.
11. Intellectual Property
- All intellectual property rights to designs, photographs and artworks remain with the artist.
- The artwork may not be reproduced, photographed or used commercially without prior written consent.
12. Privacy and Data Protection
- Personal data are used solely for order processing, administration and communication.
- Roger Wanrooij – Art & Design processes all data in compliance with the General Data Protection Regulation (GDPR).
13. Governing Law and Disputes
- All agreements are governed exclusively by Dutch law.
- Disputes will preferably be resolved amicably.
- If no resolution is reached, disputes shall be submitted to the competent court in Limburg, the Netherlands.
